These regimes have grown and developed unprecedentedly in both quantitative and qualitative terms especially in the past decade following 9/11 terrorist attacks. Opponents and proponents have offered various viewpoints on the legality or illegality of these regimes on the basis of the international law. This research first presents a theoretical framework for the assessment of those viewpoints. Since both opponents and proponents have emphasized on the relationship between these regimes and international nonproliferation regimes, their implications for availability of equipment and material related to weapons of mass destruction, conventional weapons, missiles, and dual-use goods and material are briefly discussed. Finally, developments of these regimes in addition to viewpoints of proponents and opponents about legality and illegality of export control regimes are explained using a comparative study of commitments of states members of these regimes and their commitments under international nonproliferation treaties. The conclusion is that such export control regimes, which have been developed by their members to create monopoly on technical know-how and technology, are incompatible with commitments of member states under international law رژیم‌های چند‌جانبه کنترل صادرات از جمله ابزارهایی هستند که به‌منظور حفظ تفوق تکنولوژیک و به بهانه جلوگیری از گسترش سلاح‌های کشتار‌جمعی، طی شش دهه گذشته توسط کشورهای توسعه یافته غربی مورد استفاده قرار گرفته‌اند. این رژیم‌ها، به‌ویژه طی دهه گذشته پس از حادثه یازده سپتامبر به‌طور بی‌سابقه‌ای از نظر کمی و کیفی گسترش یافته و در حال توسعه می‌باشند. درخصوص قانونی یا غیر‌قانونی بودن این رژیم‌ها بر‌اساس حقوق بین‌الملل، موافقان و مخالفان، نظرات مختلفی مطرح و تفاسیر متفاوتی ارائه کرده‌اند. در این تحقیق، به‌منظور ارزیابی این نظرات، ابتدا به بیان چارچوب نظری بحث می‌پردازیم. سپس از آنجا که در نظرات مخالفان و موافقان، رابطه این رژیم‌ها با رژیم‌های بین‌المللی عدم‌اشاعه مورد تأکید قرار گرفته، به‌طور اجمالی رژیم‌های بین‌المللی عدم‌اشاعه و رژیم‌های چند‌جانبه کنترل صادرات در خصوص تجهیزات و مواد مرتبط با سلاح‌های کشتار‌جمعی، سلاح‌های متعارف، موشک، مواد و کالاهای دومنظوره معرفی می‌شوند. در نهایت ضمن تبیین تحولات این رژیم‌ها و نظرات موافقان مبنی بر قانونی بودن و مخالفان مبنی بر غیر‌قانونی بودن رژیم‌های کنترل صادرات، با مقایسه تعهدات کشورهای عضو این رژیم‌ها با تعهداتشان تحت معاهدات بین‌المللی عدم‌اشاعه به این نتیجه می‌رسیم که این رژیم‌ها که با هدف ایجاد انحصار در دانش فنی و تکنولوژیک توسط اعضا تشکیل شده‌اند، با دیگر تعهداتشان تحت حقوق بین‌الملل مغایر می‌باشند. http://iojournal.csr.ir/en/Article/Download/37737
