Abstract :
Despite the richness of jurisprudential and legal studies on the wife's right of retention (ḥaqq al-ḥabs), these works have rarely engaged in a fundamental analysis of the concept of "right" and its interpretive impact—a gap that has led to sharp disagreements in both judicial and jurisprudential practice, particularly regarding the conflict between this right and the husband's insolvency or the installment payment of dower (mahr). This article, using a descriptive-analytical and comparative method based on documentary and library research from Imamiyya jurisprudence, aims to analyze how three major theories of right—sovereignty (sulṭanat), ownership (milkiyyat), and conventional constructivism (iʿtibāriyyat)—influence the interpretation of the right of retention and offers a practical solution to the impasse created by excessive dowries. The findings show that the sovereignty and ownership theories, due to their dogmatic nature, lead to an absolute interpretation of the right, even upholding it after a court order for installment payment. By contrast, the conventional constructivist theory, with its emphasis on public interest (maṣlaḥa) and drawing on Akhund Khurasani’s insights, reconceives the right not as an inherent privilege but as a goal-oriented instrument for achieving justice and preventing harm. Consequently, once the court issues a final ruling on fair installment payments due to the husband's insolvency, the original purpose of the right is realized; its continued exercise violates the rule against undue hardship (nafy al-ʿusr wa al-ḥaraj) and thereby invalidates the right. In conclusion, by critiquing the first two theories and highlighting the capacity of the constructivist view, this research provides a jurisprudential-legal model that redefines the right of retention within a balance between women’s financial rights and the preservation of family welfare, and offers practical reforms, including amendments to Article 1085 of the Iranian Civil Code.
